Terms and Conditions

These Terms and Conditions ("Terms") are an agreement between you and Everest Financial ("Everest Financial", "we", "us", or "our") concerning your use of Kash Budget and related services. By creating an account or using the service, you agree to these Terms and the Privacy Policy.
1. Eligibility and accounts
You must be at least 18 years old to use Kash Budget. You agree to provide accurate account information, keep your password confidential, and notify us promptly if you believe your account has been accessed without permission. You are responsible for activity under your account.
2. The service
Kash Budget lets you manually record and organize personal finance information such as accounts, transactions, income, investments, and savings goals. The service does not connect to your bank unless a future version expressly says otherwise, and it does not verify the accuracy of information you enter.
3. No financial advice
Kash Budget is an organizational and tracking tool, not a bank, financial adviser, accountant, broker, lender, or investment professional. Nothing in the service is financial, investment, tax, legal, or other professional advice. You are responsible for your financial decisions and should consult a qualified professional for advice.
4. Free and Premium plans
The Free plan may be supported by advertising. Premium is an optional ad-free subscription priced at $0.99 USD per month or $5.99 USD per year, plus applicable taxes, unless the relevant app store displays another localized price. Eligible new subscribers may receive a 7-day free trial where offered by the app store; unless cancelled before the trial ends, the selected subscription begins and renews automatically. Premium subscriptions are purchased through Apple or Google in-app billing. You can cancel through your app-store account settings. App-store terms control billing, cancellation, and refund handling.
5. Acceptable use
You may not use the service for unlawful activity, fraud, harassment, scraping, reverse engineering, security testing without permission, interference with service availability, or attempting to access another person's account or information. We may suspend or terminate access when reasonably necessary to protect users or the service.
6. Your content
You retain ownership of the finance information you submit. You grant Everest Financial a limited license to host, process, back up, and display that information only as needed to operate, secure, and improve Kash Budget. You are responsible for ensuring that your content is lawful and does not violate another person's rights.
7. Ownership
Kash Budget, including its name, design, software, and underlying materials, belongs to Everest Financial or its licensors. These Terms do not grant you ownership of our intellectual property.
8. Availability and changes
We aim to provide a reliable service but do not promise uninterrupted availability, permanent storage, or compatibility with every device. We may modify, suspend, or discontinue features, including advertising or Premium features, with reasonable notice where practicable.
9. Disclaimers and liability
The service is provided on an "as available" basis to the fullest extent permitted by law. To the fullest extent permitted by applicable law, Everest Financial will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the service. Our aggregate liability for a claim relating to the service will not exceed the fees you paid to us for the service during the 12 months before the event giving rise to the claim, subject to rights that cannot legally be limited.
10. Termination
You may stop using the service and request account deletion by contacting info@productiontracker.ca. We may suspend or terminate an account for a material violation of these Terms, legal requirements, or a security risk. Sections that by their nature should survive termination will continue to apply.
11. Changes to these Terms
We may update these Terms as the service changes. We will update the effective date and provide reasonable notice for material changes. Continued use after an updated version becomes effective means you accept the updated Terms.
12. Governing law and contact
These Terms are governed by the applicable laws of Canada, with courts located in Montreal, Canada having jurisdiction to the extent permitted by law. Questions about these Terms may be sent to info@productiontracker.ca.
